IN THE MATTER of the Application of Maritime Electric Company, Limited for an order approving the Open Access Transmission Tariff for the period beginning January 1, 2017 and for certain approvals incidental to such an order.

Order


WHEREAS Maritime Electric Company, Limited ("Maritime Electric" or "MECL") filed an application on July 8, 2016 with the Island Regulatory and Appeals Commission ("Commission" or "IRAC") for an Order approving the Open Access Transmission Tariff ("OATT") for the period beginning January 1, 2017 and for certain other approvals incidental to such order pursuant to Section 20 of the Electric Power Act;

AND WHEREAS the OATT tariff will have implications for Maritime Electric customers, both retail and wholesale;

AND WHEREAS the Commission has determined that a Technical Briefing should be held to provide an overview of the application prior to any public hearing on the application; 

AND WHEREAS the Commission has determined that it is in the public interest to hold a hearing on this matter which will allow interested parties an opportunity to participate in the determination of a just and reasonable OATT tariff;

NOW THEREFORE pursuant to the Electric Power Act, and pursuant to the Island Regulatory and Appeals Commission Act, R.S.P.E.I. 1988, Cap. 1-11,

IT IS ORDERED THAT

  1. The Application shall be heard at a public hearing before a panel of the Commission in the Commission's main hearing room, located on the 5th Floor of the National Bank Tower, 134 Kent Street, Charlottetown, Prince Edward Island, commencing at 9:30 a.m. on Monday, October 17, 2016;  

  2. The Technical Briefing by Maritime Electric shall occur in the Commission's main hearing room commencing at 9:30a.m. on Thursday, September 22, 2016;

  3. The following timetable will apply to the Application:
    Maritime Electric to file all information in support of the application by: August 26, 2016 at 4:00 p.m.
    Persons wishing to attend the Technical Briefing must register with the Commission by: September 16, 2016 at 4:00 p.m.

    Persons wishing to have intervenor status at the public hearing must file a Notice of Intention by:

    September 16, 2016 at 4:00 p.m.
    Maritime Electric to provide a technical briefing on: September 22, 2016 at 9:30 a.m.

    Persons not seeking intervenor status, but wishing to comment on the application must do so in writing by:

    October 7, 2016 at 4:00 p.m.
    Public hearing of Application October 17, 2016 at 9:30 a.m.

  4. The Notice of Application shall be published in the local newspapers forthwith, in a form approved by the Commission, and all details related to this Application shall be available on the Commission's website at www.irac.pe.ca. No further public notice shall be issued.

Notice:

Section 12 of the Island Regulatory and Appeals Commission Act reads as follows:

12. The Commission may, in its absolute discretion, review, rescind or vary any order or decision made by it, or rehear any application before deciding it.

Parties to this proceeding seeking a review of the Commission's decision or order in this matter may do so by filing with the Commission, at the earliest date, a written Request for Review, which clearly states the reasons for the review and the nature of the relief sought.

Sections 13.(1), 13(2), 13(3), and 13(4) of the Act provide as follows:

13.(1)   An appeal lies from a decision or order of the Commission to the Court of Appeal upon a question of law or jurisdiction.

(2) The appeal shall be made by filing a notice of appeal in the Court of Appeal within twenty days after the decision or order appealed from and the rules of court respecting appeals apply with the necessary changes.

 (3) The Commission shall be deemed to be a party to the appeal.

(4) No costs shall be payable by any party to an appeal under this section unless the Court of Appeal, in its discretion, for special reasons, so orders.

NOTE:

In accordance with IRAC's Records Retention and Disposition Schedule, the material contained in the official file regarding this matter will be retained by the Commission for a period of 5 years.
