Order


WHEREAS the MacMillan Point Water Utility (the "Utility") filed an application with the Island Regulatory and Appeals Commission (the "Commission") for approval to increase annual water rates and charges, effective January 1, 2017;

AND WHEREAS following receipt of the Utility's filing, the Commission posted details of the application on its website and issued a Notice to ratepayers inviting written comments on the Utility's proposal;

AND WHEREAS in response to the Notice, the Commission received written comments from five customers expressing concern over the amount of the proposed increase;

AND WHEREAS the Commission conducted a thorough review of the Utility's application and financial information;

AND WHEREAS the Commission concluded that increased operating costs, and recent improvements to the central water system, result in the need for additonal revenues;

AND WHEREAS it appears to the Commission that the tariff of water rates and charges approved herein are necessary and equitable;

NOW THEREFORE, pursuant to the Water and Sewerage Act and the Island Regulatory and Appeals Commission Act

IT IS ORDERED THAT

1. The water rate tariff of the MacMillan Point Water Utility, as set out in schedule 1 annexed hereto and forming part of this Order, is approved and declared effective as of January 1, 2017, and shall remain in effect until otherwise ordered by the Commission.

NOTICE

Section 12 of the Island Regulatory and Appeals Commission Act reads as follows:

12. The Commission may, in its absolute discretion, review, rescind or vary any order or decision made by it or rehear any application before deciding it.

Parties to this proceeding seeking a review of the Commission's decision or order in this matter may do so by filing with the Commission, at the earliest date, a written Request for Review, which clearly states the reasons for the review and the nature of the relief sought.

Sections 13.(1), 13(2) 13(3) and 13(4) of the Act provide as follows:

13.(1)  An appeal lies from a decision or order of the Commission to the Court of Appeal upon a question of law or jurisdiction.

(2) The appeal shall be made by filing a notice of appeal in the Court of Appeal within twenty days after the decision or order appealed from and the rules of court respecting appeals apply with the necessary changes.

(3) The Commission shall be deemed to be a party to the appeal. 

(4) No costs shall be payable by any party to an appeal under this section unless the Court of Appeal, in its discretion, for special reasons, so orders.

WATER RATE TARIFF
 

MacMillan Point Water Utility Inc.

EFFECTIVE: January 1, 2017 

This rate tariff is issued pursuant to Commission Order UW17-02 and specifies
the rates and charges applicable to services provided by the

MacMillan Point Water Utility inc.

Rules and regulations governing the types of services and manner
in which such services are provided are contained in the

MACMILLAN POINT WATER UTILITY INC. WATER RULES AND REGULATIONS,
approved effective January 1, 2010 (per Order UW10-01). 


Water Services Rates and Charges

Application:

Rates and charges apply to water services provided to properties served, or capable of being served, by the MacMillan Point Water Utility Inc.

Flat Rate:

$350.00 per year for each developed property.

Frontage Rate:

A frontage charge of one dollar and seventy-five cents ($1.75) per lineal foot per year shall apply to all land adjacent to streets, roads or highways on which there are no buildings or structures but which land is capable of being serviced by the existing facilities of the water utility.

In the case of developed properties billed under the Flat Rate Charge, a frontage charge of one dollar and seventy-five cents ($1.75) per lineal foot per year, less an exemption of one hundred (100) feet, shall apply to all land capable of being serviced by the existing facilities of the water utility.

In the case of corner properties with water facilities on both sides, the frontage charge shall apply to the full frontage on the longest side, and the full frontage less one hundred (100) feet on the other side, less an exemption of one hundred (100) feet for developed properties, where applicable.

The minimum bill to a customer charged frontage shall be $175.00 (100 feet).

The maximum bill to a customer charged frontage shall be $525.00 (300 feet).
