IN THE MATTER of an application by Maritime Electric Company, Limited for approval of an Open Access Transmission Tariff.

Notice of Application

TAKE NOTICE that Maritime Electric Company, Limited (“Maritime Electric” or the “Company”) has applied to the Island Regulatory and Appeals Commission (the “Commission”) for approval of an Open Access Transmission Tariff (OATT). The OATT defines the proposed terms, conditions and price for wholesale access to Maritime Electric’s transmission system and is required to set out the arrangements between Maritime Electric and others who wish to directly access the transmission system.

BACKGROUND

In 2006, the Commission ordered Maritime Electric to file a proposed OATT. The Company originally filed its proposal in November, 2006 and, at the direction of the Commission, subsequently engaged in a stakeholder review process. On October 3, 2007, the Company filed an amended application for Commission approval.

The filing explains the tariff and pricing methodology used by the Company in its proposal. According to the Company, the proposed tariff complies with the reciprocity requirements of the Federal Energy Regulatory Commission, the organization that governs wholesale transmission access in the United States.

HOW TO COMMENT

Any person wishing to comment on the application can do so by writing to the Commission at the address below. In order to be considered, comments must be received by December 31, 2007.

Parties who wish to intervene and participate in any hearing the Commission may convene to consider the application must file a Notice of Intervention with the Commission, with a copy to the Company, by December 31, 2007. Parties who file a Notice of Intervention will be later advised of the review procedure the Commission will follow in this matter.
