Notice of Application

TAKE NOTICE that Maritime Electric Company, Limited ("Maritime Electric" or the "Company") has filed for the approval of the Island Regulatory and Appeals Commission (the "Commission") the Company's 2011-2015 Demand Side Management Plan.

BACKGROUND
On December 20, 2005, the Renewable Energy Act (the "Act ") came into effect in Prince Edward Island. Subsections 6(3) and 6(4) of the Act read as follows:

(3) Every public utility shall, before September 1, 2010, prepare and submit to the Commission for its approval a plan of the demand side management measures that the public utility proposes to undertake during the period beginning on January 1, 2011 and ending on December 31, 2015 to ensure that the reduction in the intensity of peak demand by rate payers for electric energy from the public utility by the end of that period exceeds or is equal to the percentage reduction required to obtain the approval of the Commission under subsection (4).

(4) The Commission may, on receipt of a demand side management plan for the period referred to in subsection (3), approve the plan if the Commission is satisfied that, after the implementation of the measures set out in the plan, the intensity of the peak demand for electric energy from the public utility for the calendar year 2015 is likely to be at least 10% less than the intensity of the peak demand for electric energy from the public utility for the calendar year 2004.

Maritime Electric’s plan outlines the initiatives planned to achieve the 2011 - 2015 Demand Side Management (DSM) targets. Under the Act, the Commission is required to approve the plan. This filing will establish the components of the DSM plan which will work towards the legislated requirements under the Act.

HOW TO COMMENT AND ASK QUESTIONS
Any person wishing to comment on the filing can do so by writing to the Commission at the address below. In order to be considered, comments must be received by Friday, October 29, 2010. Persons wishing to pose questions to Maritime Electric on the filing may do so by sending their questions, in writing, to the Company on or before Friday, September 24, 2010. Questions posed to Maritime Electric must be answered by the Company, in writing, on or before Friday, October 8, 2010. Copies of both written questions and written answers must be copied to, or filed with, the Commission not later than October 29, 2010 in order to be considered.
