Order
WHEREAS the
Commission received on March 19, 2003 a Notice of Appeal filed by Gloria
Alexander;
AND WHEREAS
the Commission received on March 28, 2003 an
e-mail from Monica MacDonald advising that they would not be contesting the
appeal and instructed the Commission to forward the $67.75 awarded to the
Lessors in Order LD03-048 to the Lessees;
AND WHEREAS
the Commission received on March 31, 2003, a letter from Gloria
Alexander advising that she would withdraw the appeal if she received the
$67.50 awarded to the Lessors in Order LD03-048;
AND WHEREAS
for the reasons given above, the appeal is
determined to be withdrawn.
NOW THEREFORE
the Commission authorizes the Office of the Director of Residential Rental
Property to release the security deposit held in trust in the amount of
$150.00 to Gloria and Lawrence Alexander.
IT IS ORDERED THAT
- The appeal is withdrawn.
- The security deposit in the amount of $150.00 be forwarded to Gloria
and Lawrence Alexander.

NOTICE
Sections 26.(2), 26.(3), 26.(4) and 26.(5) of
the
Rental of Residential Property Act provide as follows:
26.(2)
A lessor or lessee may, within fifteen days of the decision of the Commission, appeal to
the court on a question of law only.
(3) The rules of court governing appeals apply to an appeal under
subsection (2).
(4) Where the Commission has confirmed, reversed or varied an order of the
Director and no appeal has been taken within the time specified in subsection (2), the
lessor or lessee may file the order in the court.
(5) Where an order is filed pursuant to subsection (4), it may be enforced
as if it were an order of the court.
