Order P.921006 - Petroleum - Atlantic Speedy Propane Limited

IN THE MATTER of an application filed under Section 32 of the Petroleum Products Act, supra, by Atlantic Speedy Propane Limited for increases in its propane pricing schedule.

WHEREAS further to the Commission's Interim Order No. P.920623, Counsel for Atlantic Speedy Propane Limited ("Atlantic"). filed on 23 September 1992 an application dated 18 September 1992 with the Island Regulatory and Appeals Commission (the "Commission") requesting permission to increase the price of propane to its customers in the amount of 1.0 cent per litre;

AND WHEREAS a declaration made in the supporting Affidavit of Douglas Goddard, General Manager of Atlantic, dated 18 September 1992 indicated that propane acquisition costs would increase on 22 September 1992 by 1.0 cent per litre; which Affidavit was supported by a copy of a letter to this effect dated 17 September 1992 from Robert Johnston of Irving Oil Limited (Irving), its supplier;

AND WHEREAS the Application was reviewed and further information was sought by Commission Staff on 25 September 1992;

AND WHEREAS additional information was filed by Counsel for the Applicant on 28 September 1992 by way of copies of invoices dated 26 June and 23 September 1992 indicating that the acquisition cost to Atlantic Speedy Propane Limited by its supplier, Irving Oil Limited had in fact increased by one cent per litre;

AND WHEREAS the additional information sought from the Applicant by the Commission was filed by Counsel for the Applicant on 1 October 1992;

AND WHEREAS the Commission considered this Application and supporting documentation this date;

AND WHEREAS Atlantic has requested that the increase sought not apply to the category of Irving Oil Dispenser Operators, this matter will be further considered with a view to determining whether or not such action would negatively affect other Dispenser Operators not branded Irving;

THE COMMISSION HEREBY ORDERS that the propane prices to be charged by Atlantic Speedy Propane Limited, effective 12:01 a.m., Friday, 9 October 1992, be increased by 1.0 cent per litre, except in the case of Irving Oil Dispenser Operators, in accordance with Appendix "A" to this Interim Order, until otherwise ordered by the Commission.
