IN THE MATTER of an application filed under Section 32 of the Petroleum Products Act, supra, by ULTRAMAR CANADA INC. for a decrease of 2.0 cents per litre in its posted consumer tank truck prices of gasoline, due to market conditions.

Decision and Order

WHEREAS an application dated 5 April 1993 and affidavit signed the same date was submitted to the Commission under Section 32 of the Petroleum Products Act by R. D. Munn, Director - Corporate Planning for Ultramar Canada Inc., requesting approval for a decrease of 2.0 cents per litre in the prices of all gasoline products contained in Ultramar's posted consumer tank truck pricing schedule, effective immediately, due to market conditions;

AND WHEREAS certain of the supporting information concerning competitors' prices which accompanied the application was incorrect, which inaccuracy was pointed out to the applicant by Division staff;

AND WHEREAS the Commission reviewed this application and supporting information, as well as other information relating to pricing at its meeting of 6 April 1993;

AND WHEREAS the Commission, after consideration, approved the application;

THE COMMISSION THEREFORE ORDERS AS FOLLOWS:

1. THAT the following wholesale posted consumer tank truck prices (which prices do not include Provincial tax or seven per cent G.S.T.) shall be in effect in the Province of Prince Edward Island for the wholesaler Ultramar Canada Inc., effective 12:01 a.m. on 8 April 1993:

Mid-Grade unleaded gasoline 44.32

2. THAT the prices quoted in this Order, with adjustments resulting from tax changes only, shall remain in effect until otherwise ordered by the Commission.
