UPON the application of Kimball Darte for an order of the Commission respecting the cutting of the wires or lines of wires or cables of Maritime Electric Company, Limited (the "Company") to permit the movement of a building in one section from 95 Fitzroy Street to 73 Chestnut Street in the City of Charlottetown in Queens County, Prince Edward Island;

AND UPON reading the written permission of the City of Charlottetown, dated April 4, 2001 authorizing the movement of the said building on April 21, 2001 or April 22, 2001 only;

AND UPON reading a letter dated April 9, 2001 from the Company advising that an interruption of electric power resulting from the cutting of the said wires or lines of wires or cables may affect certain customers of the Company in the area of the movement of the said building for a period of two hours;

NOW THEREFORE pursuant to the Section 40 of the Electric Power and Telephone Act

IT IS ORDERED THAT

1.  on April 21, 2001 or April 22, 2001, Maritime Electric Company, Limited shall permit the movement of a building in one section through wires or lines of wires or cables from 95 Fitzroy Street to 73 Chestnut Street in Charlottetown in Queens County in Prince Edward Island.

12.  The Commission may, in its absolute discretion, review, rescind or vary any order or decision made by it or rehear any application before deciding it.

Parties to this proceeding seeking a review of the Commission's decision or order in this matter may do so by filing with the Commission, at the earliest date, a written Request for Review, which clearly states the reasons for the review and the nature of the relief sought.

Sections 13.(1) and 13(2) of the Act provide as follows:

13.(1) An appeal lies from a decision or order of the Commission to the Appeal Division of the Supreme Court upon a question of law or jurisdiction.

(2) The appeal shall be made by filing a notice of appeal in the Supreme Court within twenty days after the decision or order appealed from and the Civil Procedure Rules respecting appeals apply with the necessary changes.
