Order
WHEREAS
the
Commission, by Order UW02-02 issued on February 7, 2002, granted approval to the
Tignish Sewage Collection and Water Distribution Corporation (the
"Utility")
to increase its Tariff of rates and charges for sanitary sewerage services,
effective January 1, 2002;
AND WHEREAS analysis
carried out during the review of the Utility's
sewer rate application indicated that the Utility's water rates appeared high in
relation to its expenditure levels;
AND WHEREAS
the Commission requested and
was provided with the Utility's forecasted
water revenues and expenditures to 2003;
AND WHEREAS,
following an analysis of the supplementary information provided by the Utility,
it appeared that a downward adjustment to the water rates and charges was
warranted;
AND WHEREAS,
in February 2002, the Utility was advised that an Order of the Commission would
be issued to reduce the water rates effective January 1, 2003, unless it was
provided with additional financial or other information that might otherwise
impact on the proposed downward rate adjustment;
AND WHEREAS,
based on a thorough
analysis of the Utility's forecast revenue and expenditure levels, and an
understanding that there has been no material change in the Utility's
financial position, the Commission has concluded that a water rate of $160.00
per unit per annum is necessary and equitable;
NOW THEREFORE, pursuant to the Island Regulatory and Appeals Commission Act
and the Water and Sewerage Act;
IT IS ORDERED THAT
1. The existing Tariff for
water services of the Community of Tignish Sewage Collection and
Water Distribution Corporation is revoked and the Tariff appended to, and
forming part of, this Order is substituted therefore; and
2. The
appended Tariff is approved and declared effective on January 1, 2003 and shall
remain in effect until otherwise ordered by the Commission.

NOTICE
Section 12 of the Island Regulatory and Appeals Commission Act
reads as follows:
12.
The Commission may, in its absolute discretion, review, rescind or vary any order or
decision made by it or rehear any application before deciding it.
Parties to this proceeding seeking a review of the Commission's
decision or order in this matter may do so by filing with the Commission, at the earliest
date, a written Request for Review, which clearly states the reasons for the review
and the nature of the relief sought.
Sections 13.(1) and 13(2) of the Act provide as follows:
13.(1)
An appeal lies from a decision or order of the Commission to the Appeal Division of the
Supreme Court upon a question of law or jurisdiction.
(2) The appeal shall be made by filing a
notice of appeal in the Supreme Court within twenty days after the decision or order
appealed from and the Civil Procedure Rules respecting appeals apply with the necessary
changes.

The following rates and charges apply to water services provided
to premises served or capable of being served by the Tignish Sewage Collection
and Water Distribution Corporation.

$160.00 per unit per annum in accordance with the appended
