Order

WHEREAS the North Rustico Water and Sewer Utility Corporation (the "Utility"), by application filed on September 22, 2005 and as amended December 13, 2005 and January 27, 2006, applied to the Commission for approval to increase its water rates and charges;

AND WHEREAS the specifics of the proposed increases are set out below:

AND WHEREAS following receipt of the Utility's application, the Commission published a notice in a local newspaper inviting written comments on the proposed application;

AND WHEREAS the Commission received one written submission in response to its public Notice;

AND WHEREAS the Commission has considered the application of the Utility and supporting information, as well as the public written submission;

AND WHEREAS the Commission has, based on a thorough analysis of the application and the Utility's audited financial statements and projected revenue and expenditure requirements, concluded that:

• increased operating expenditures related to the central water distribution plant, including expenditures for the contracting out of qualified personnel and fees associated with water quality testing, as well as additional costs for ongoing repairs and maintenance of the system, have increased the Utility's overall expenditure levels and result in the need for additional revenue;

AND WHEREAS  the Commission considers that an annual water rate of $260.00 per unit, effective with service provided on and after January 1, 2006, is necessary and equitable;

NOW THEREFORE, pursuant to the Island Regulatory and Appeals Commission Act and the Water and Sewerage Act;

IT IS ORDERED THAT

1.   The existing Tariff for water services of the North Rustico Utility is revoked and the Tariff appended to, and forming part of, this Order is substituted therefor; and

2.   The appended Tariff is approved and declared effective on January 1, 2006 and shall remain in effect until otherwise ordered by the Commission.

NOTICE

Section 12 of the Island Regulatory and Appeals Commission Act reads as follows:

12. The Commission may, in its absolute discretion, review, rescind or vary any order or decision made by it or rehear any application before deciding it.

Parties to this proceeding seeking a review of the Commission's decision or order in this matter may do so by filing with the Commission, at the earliest date, a written Request for Review, which clearly states the reasons for the review and the nature of the relief sought.

Sections 13.(1) and 13(2) of the Act provide as follows:

13.(1) An appeal lies from a decision or order of the Commission to the Appeal Division of the Supreme Court upon a question of law or jurisdiction.

(2) The appeal shall be made by filing a notice of appeal in the Supreme Court within twenty days after the decision or order appealed from and the Civil Procedure Rules respecting appeals apply with the necessary changes.

THIS TARIFF SPECIFIES THE RATES AND CHARGES
APPLICABLE TO SERVICES PROVIDED BY THE
NORTH RUSTICO SEWER AND WATER
UTILITY CORPORATION

Water Service Rates and Charges

Application:

The following annual rates and charges apply to water services provided to premises served or capable of being served by the North Rustico Sewer and Water Utility Corporation.

Flat Rate (Unmetered):

For each unmetered customer the sum of:

A.    a customer charge of $166.20; and

B.    a demand charge of $93.80 per proportionate demand unit calculated in accordance with the Proportionate Demand Charges contained on page 2 of this Tariff.

Metered Service:

For each metered customer the sum of:

A.    a customer charge of $166.20; and

B.    a flow charge of $1.44 per thousand gallons.

Minimum Bill:

The minimum bill to any customer shall be the applicable customer and demand charges.

Fire Protection Charge:

Per Hydrant - $435.37 per annum.
