Maurice Rodgerson, Chair Order WHEREAS Crapaud Sewage Collection and Treatment Corporation (the "Utility"), by application filed on May 11, 2006, applied to the Commission for an increase in its Tariff of rates and charges for sewer services, effective January 1, 2006; AND WHEREAS the specifics of the proposed sewer rate increase are set out below:
AND WHEREAS following receipt of the said application, the Commission published a Notice of Application in the local newspaper inviting written comments on the Utility's proposal: AND WHEREAS the Commission did not receive any written submissions in response to its public notice; AND WHEREAS the Commission has considered the submission of the Utility and supporting operating and financial data; AND WHEREAS following a review of the application and the Utility's financial statements, the Commission has concluded that higher costs associated with upgrades to the sanitary sewage system in 2006 and 2007 will increase the Utility's expenditures; AND WHEREAS the Commission considers that an annual sewer rate of $150.00 per unit, effective with service provided on and after January 1, 2007, is necessary and equitable; NOW THEREFORE, pursuant to the Island Regulatory and Appeals Commission Act and the Water and Sewerage Act; IT IS ORDERED THAT The existing Tariff for sewer services of the Crapaud Sewage Collection and Treatment Corporation is revoked and the Tariff appended to, and forming part of, this Order is substituted therefore; and; 2. The appended Tariff is approved and declared effective on January 1, 2007 and shall remain in effect until otherwise ordered by the Commission. Sections 13.(1) and 13(2) of the Act provide as follows: (2) The appeal shall be made by filing a notice of appeal in the Supreme Court within twenty days after the decision or order appealed from and the Civil Procedure Rules respecting appeals apply with the necessary changes.
