IN THE MATTER of an application by
the Crapaud Sewage Collection and Treatment Corporation for
an increase in its tariff of sewer rates and charges.
BEFORE THE
COMMISSION
on Friday, the

Order
WHEREAS the Crapaud Sewage Collection and Treatment Corporation
(the "Utility"), by application submitted on January 11,2012, as amended
February 6, 2012, applied to the Island Regulatory and Appeals Commission (the
"Commission") for amendments to its Tariff of sewer rates and charges;
AND WHEREAS
specifically, the Utility requested approval to increase its current rate of
$150.00 to $385.00 per unit per year, effective January 1, 2012;
AND WHEREAS following receipt of the application, the Commission published a Notice
on its website and in the local
newspaper inviting written comments on the Utility's proposal;
AND WHEREAS
following the February 24th, 2012 deadline, the Commission did not
receive any written submissions in response to the notice;
AND WHEREAS
the Commission
has reviewed the submission of the Utility and supporting operating and
financial data:
AND WHEREAS the
Commission has noted that the Utility's share of infrastructure costs
related to recent wastewater plant upgrades impacts the Utility's revenue
requirement;
AND WHEREAS
the
Commission has further noted that an additional component of the treatment
plant upgrades involving the removal of sludge remains outstanding at the
time of the signing of this Order, and that the rate impact associated with
this part of the project is not included in projections provided in the
current rate proposal under consideration; AND WHEREAS the
Commission has also noted that, depending on available funding for the
sludge removal project, additional rate relief may be necessary in the next
1-3 years, and that the Utility is aware of the possible additional revenue
requirement;
AND WHEREAS the
Commission, following a thorough review of the application and the Utility's
financial statements, has concluded that increased operating expenditures
associated with the treatment plant upgrades have increased the Utility's
expenditure levels and result in the need for additional revenues;
AND WHEREAS the Commission
considers that an annual sewer rate of $385.00 per unit for customers,
effective with service provided on and after January 1, 2012, is necessary
and equitable at this time;NOW THEREFORE,
pursuant to the
Island Regulatory and Appeals Commission
Act and
the
Water and Sewerage Act
IT IS ORDERED THAT
1. The existing Tariff for
sewer services of the Crapaud Sewage Collection and Treatment
Corporation will be revoked and the Tariffs appended to, and
forming part of, this Order, is substituted therefore; and
2. The appended Tariff is
approved and declared effective on January
1, 2012 and shall remain in effect
until otherwise ordered by the Commission.

NOTICE
Section 12 of the
Island Regulatory and Appeals Commission Act
reads as follows:
12. The Commission may, in its absolute discretion, review, rescind or vary
any order or decision made by it or rehear any application before deciding it.
Parties to this proceeding seeking a review of the Commission's decision or
order in this matter may do so by filing with the Commission, at the earliest
date, a written Request for Review, which clearly states the reasons for the
review and the nature of the relief sought.
Sections 13.(1) and 13(2) of the
Act provide as
follows:
13.(1) An appeal lies from a decision or order of the
Commission to the Court of Appeal upon a question of law or jurisdiction.
(2) The appeal shall be made by filing a notice of appeal
in the Court of Appeal within twenty days after the decision or order
appealed from and the rules of court respecting appeals apply with the
necessary changes.
NOTE: In accordance with IRAC's
Records Retention and Disposition Schedule, the material contained in the
official file regarding this matter will be retained by the Commission for a
period of 5 years.
