IN THE MATTER of the
establishment of an interim Tariff for communal water services provided in the Northgate
Subdivision by the Cornwall Sewage Collection and Water Distribution Corporation.

Order
WHEREAS by Permit No W92/4
approved on Thursday, February the 13th, 1992, and issued on Thursday, February the 20th,
1992, The Island Regulatory and Appeals Commission ("Commission") authorized the
acquisition by the Cornwall Sewage Collection and Water Distribution Corporation
("Cornwall") of the public utility assets of Northgate Waterworks Inc.
("Northgate"), the public utility providing communal water services to residents
of the Northgate subdivision in the Community of Cornwall;
AND WHEREAS the operation of the
public utility assets located in the Northgate subdivision has, effective on the date of
acquisition, been transferred to Cornwall;
AND WHEREAS the Commission deems
it necessary to establish, on an interim basis, a Tariff for the provision of communal
water services in the said subdivision by Cornwall;
IT IS THEREFORE ORDERED THAT
1. the existing Tariffs of Cornwall approved by the Public
Utilities Commission under Order S870625 and Order W91-5 are revoked and the Tariff
appended to, and forming part of, this Order is substituted therefor;
2. the water rates contained in the appended Tariff that
apply to customers in the Northgate subdivision are approved effective January 1, 1992 on
an interim basis, pending further Order of the Commission;
3. revenues collected by Cornwall from customers in the
Northgate subdivision for water services provided during the period January 1, 1992 to the
date of acquisition shall be transferred to Northgate within sixty days from the date of
acquisition;
4. the Tariff of Northgate approved by the Public Utilities
Commission under Order W890906 is revoked effective January 1, 1992;
5. the rates applicable to all water customers of the
Cornwall Water Utility including those in the said Northgate subdivision shall, at a date
to be later determined by the Commission, be brought to a uniform level; and
6. a copy of this Order and the Permit authorizing the
acquisition are to be distributed by Commission staff to water customers in the Northgate
subdivision.
