UPON the application of Seawood Estates Inc. Water and Sewerage Utility (the "Applicant") for review and variance to Public Utilities Commission Order W91-12 herein dated October the 2nd, 1991;

AND UPON reading submissions in this matter from R.H. Wygant, the Applicant's President, T.E. Richardson, a consultant engaged by the Applicant in this matter and Owen Green, a customer of the Applicant;

AND UPON it appearing to the Commission that an Order variance is warranted;

NOW THEREFORE, pursuant to Section 12 of the Island Regulatory and Appeals Commission Act, Stats. P.E.I. 1991, Cap. 1;

IT IS ORDERED THAT:

1. Order W91-12 of the Public Utilities Commission is hereby varied as follows:

· the 10% rate increase authorized therein for effect on January 1, 1992 is increased to 14%;

· the 10% rate increase authorized therein for effect on January 1, 1993 is increased to 14%; and

2. the Tariffs appended to Public Utilities Commission Order W91-12 are revoked and the Tariffs appended to, and forming part of, this Order are substituted therefor.
