Order

WHEREAS the Tyne Valley Sewage Utility (the "Utility"), by application filed on November 5, 2007, applied to the Commission for an increase in its Tariff of sewer rates and charges, effective July 1, 2007;

AND WHEREAS, the specifics of the Utility's proposal are outlined as follows:

  Current Rate Proposed Rate
(Per Proportionate Unit/Per Year)
Customers on Central System $60.00 $120.00
Customers on Septic System $50.00 $60.00

AND WHEREAS following receipt of the application, the Commission published a Notice in the local newspapers inviting written comments on the Utility's proposal;

AND WHEREAS the Commission received one written submission in response to its public Notice;

AND WHEREAS the Commission has considered the submission of the Utility and supporting operating and financial data, as well as the comments received in response to the application;

AND WHEREAS the Commission considers it the Utility's responsibility to pump affected septic system customers' tanks once every 2 years;

AND WHEREAS the Commission, following a review of the application and financial statements, has concluded that higher costs to operate the Utility result in the need for additional revenue;

AND WHEREAS the Commission considers that an annual sewer rate of $120.00 per unit for customers on the central system; and an annual sewer rate of $60.00 per unit for septic system customers, effective with service provided on and after January 1, 2008, are necessary and equitable;

NOW THEREFORE, pursuant to the Island Regulatory and Appeals Commission Act and the Water and Sewerage Act;

IT IS ORDERED THAT

1.  The existing Tariff for sewer services of the Tyne Valley Sewage Utility is revoked and the Tariff appended to, and forming part of, this Order is substituted therefore; and

2.  the appended Tariff is approved and declared effective on January 1, 2008 and shall remain in effect until otherwise ordered by the Commission.

DATED at Charlottetown, Prince Edward Island, this 31st day of January, 2008.
