Effective January 1, 2023, the Government of Canada has enacted a prohibition on non-Canadians from purchasing residential property in Canada, with some exceptions. Under this legislation, some properties in Prince Edward Island are affected. This may impact applications under the Lands Protection Act that are filed by non-Canadians.
When filing a non-resident application under Section 4 of the Lands Protection Act, non-Canadian applicants will need to provide the Commission with a submission detailing how the Prohibition on the Purchase of Residential Property by Non-Canadians Act applies to the proposed transaction. This submission must be received prior to the application being processed.
